What Surety Bonds Are Needed In Texas?
Necessary surety bonds in Texas generally fall into one of these categories: license or permit bonds, contractor bonds, and court bonds.
Texas License and Permit Bonds
License and permit bonds are often required as a guarantee that a business licensed to do business in Texas operates in accordance with all applicable rules and regulations governing that particular profession or industry. This protects consumers and the state or specific municipality from financial loss due to the company’s actions. A license or permit bond must be renewed periodically to prevent the suspension or revocation of the business license.
Several different state agencies that grant business licenses require license applicants to purchase a license and permit bond. Among these agencies are the:
- Department of Licensing and Regulation, which licenses talent agencies, polygraph examiners, professional employer organizations, personnel employment services, staff leasing services, for-profit legal services, combative sports promoters, athletic agents, and barber schools
- Department of Insurance, which licenses escrow officers, title insurance agents, public adjustors, navigators, insurance agencies, and discount health care programs
- Secretary of State, which licenses third party debt collectors, health aps, and credit services organizations
The state of Texas does not require construction contractors to obtain a license and a license bond in order to do business—but a number of cities and municipalities in Texas do. These include Austin, Port Aransas, El Paso, Galveston, Amarillo, El Campo, Abilene and others. Some cities require only home improvement contractors or specialty contractors like electricians to be licensed and to purchase a license or permit bond.
Texas Construction Bonds
In addition to contractor license bonds, other types of construction bonds may be required at the city or county level, such as bid bonds, performance bonds, or payment bonds. Obtaining contractor bonds may be a condition for working on public construction projects in some jurisdictions.

One is to ensure payment in cases involving the appeal of a court decision ordering a plaintiff or defendant to pay damages, court costs, and/or legal fees. The other is to guarantee that people serving in a fiduciary role, such as executor of an estate or guardian of a minor, comply with the law in executing their duties.
